I`ve never seen it, but here`s an example of how it`s possible. The seller may agree to compensate the buyer`s agent at 2.5% of the sale price, but the buyer`s representation agreement with the agent indicates that the buyer`s representative receives 3%. There are three ways to do this. First, the buyer`s representative could negotiate with the seller to get the full 3%, regardless of what is listed in the listing agreement. Second, the buyer can pay at the end the 0.5% of the purchase price at the close to make up the difference. Or third, and probably the most likely scenario, the buyer`s broker simply whispers with his reduced commission, but is silent and tries not to swing the boat. None of these practices are false or fair. Preparing your own document or amending a rental agreement prepared by a lawyer for another transaction is a violation of the Real Estate Licensing Act. In addition, you may be sued by the parties if they disagree on the lease you are preparing. On Saturday evening, the listing agent notifies the buyer`s agent that the seller has accepted the buyer`s offer. The seller clearly accepted the offer and signed the contract. The buyer`s representative informs the stockbroker that he cannot inform the buyer of his acceptance until Monday. Should brokers insert Monday as a validity date? This does not mean that a seller will never be able to use an unauthorized craftsman for electrical repairs.
This means that the seller must use a licensed electrician, unless there is a written agreement between the buyer and the seller to use this unauthorized craftsman for electrical repairs. Another possibility is to design a completely customized contract that corresponds to specific circumstances, but this rarely happens, as non-standard contracts tend to push agents and brokers out of their comfort zone, at least in the residential area. Custom contracts are much more common in large business transactions. Section 5.008 of the Texas Property Code lists legal exceptions to the seller`s disclosure obligations.
